VoiceMe, Inc. (“VoiceMe”, “we” or “us”) is committed to protecting and respecting your privacy. This privacy policy (the “Policy”) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read this Policy carefully, in order to understand our practices in relation to your personal data. By using www.voiceme.io (the “site”) or the YouVoice app (the “App”), you are accepting the practices described in this Policy.

INFORMATION WE MAY COLLECT FROM YOU

Throughout your use of the site, the App and your interactions with us, we may collect the information described below, which may be used to identify you personally (“personal information”), as well as information that does not identify you. We may collect and process the following data about you:

Chat messages between users are not stored by YouVoice/VoiceMe. As of now we understand that our third party service Quixxblos is storing data until both parties have deleted their accounts .. even after that. We should cover that as we cannot quickly change that technically. At the start of every call with another user or users,we log the fact that a call has occurred between you and that user or users. This record includes a timestamp, as well as an IP address, ID cookie, and similar information for both you and the other user or users you speak with.

COOKIES

We may assign your device one or more cookies, to help understand and personalize your experience. Cookies are small bits of information stored on your device that allow us to collect information about your activity on the site and App (such as pages you visit, time of your visits and the links you click on).

HOW WE WILL USE THE INFORMATION WE COLLECT

We will use the information we collect from you to:

INFORMATION MADE AVAILABLE TO OTHER USERS

When you register to use our service, you can choose to have your YouVoice profile viewable to (a) all users of YoiVoice (Public) ; (b) YouVoice Friends of your YouVoice Friends; or (c) your YouVoice Friends only. When you register to use YouVoice, your profile will be set as viewable to all users of YouVoice unless you select otherwise, when prompted to do so during the registration process.

Important – please be aware that users can potentially share screen shots of your chat logs and messages with other people and so you should take care not to reveal information which you wish to remain confidential when using the service. Messages sent to other YouVoice users who are YouVoice Friends and received from other YouVoice users who are YouVoice Friends may be stored locally on your device as well as centrally to provide the messaging services and may be accessed by YouVoice to comply with general legal requirements. You are unable to delete messages sent/received unless the YouVoice Friend to whom the message was sent or from whom it was received is deleted as a YouVoice Friend.

SHARING YOUR PERSONAL DATA

We do not share your personal information with others, except as indicated in this Policy or when we inform you and give you the opportunity to opt out of having your personal information shared. Under this Policy, we may share your personal information:

WHERE WE STORE YOUR PERSONAL DATA

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy.

Unfortunately, the transmission of information via the internet is not completely secure. Terms of Use

Welcome to www.voiceme.io (our “site”). Please read these terms (the “Agreement”) carefully before using the YouVoice app (the “App”) or our site (collectively, the “Services”). By using our Services you confirm that you accept the terms of this Agreement and agree to comply with them. If you do not agree to these terms, you must not use our Services. Throughout this Agreement, “you” refers to the user of our Services, and “we”, “us” or “VoiceMe” means VoiceMe, Inc. (and any of its successors, subsidiaries, divisions or assignees, as applicable).

This Agreement incorporates by reference our Privacy Policy, which also applies to the use of our Services. Please take time to read and understand it. By using our Services, you consent to us processing personal data in accordance with the Privacy Policy.

CHANGES TO THIS AGREEMENT

We reserve the right to change or modify this Agreement at any time. Such changes will become effective immediately upon being posted on the site or the App. Your continued use of our Services after any changes have been made shall be deemed to constitute acceptance by you of any such changes, modifications, additions or deletions. You should review this Agreement regularly so that you are aware of any such revisions.

ACCESSING OUR SERVICES

Our Services are made available free of charge. We do not guarantee that our Services will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or any part of our Service without notice or any liability to you at any time. We will not be liable to you if for any reason our Service is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our Services. You are also responsible for ensuring that all persons who access our Services through your internet connection are aware of this Agreement, and that they comply with it.

Our Services are directed to people residing in the United Kingdom. We do not represent that content available on or through our Service is appropriate or available in other locations. We may limit the availability of our Service to any person or geographic area at any time. If you choose to access our site from outside the United Kingdom, you do so at your own risk.

ELIGIBILITY

You must be 12 years of age or older to use our Service. By using our Service, you represent and warrant to VoiceMe that you are 12 years of age or older, and that you have the right, authority and capacity to agree to and abide by this Agreement. You also represent and warrant to VoiceMe that you will use the Service in a manner consistent with any and all applicable laws and regulations.

PROPRIETARY RIGHTS

We are the owner or the licensee of all intellectual property rights in our Service. Our Service is protected by copyright laws and treaties around the world, and all such rights are reserved.

We assert full copyright protection in the Service. Information posted by us may be protected whether or not it is identified as proprietary. Any content you upload to the site or the App, will be considered non-confidential. You retain ownership rights in the content you upload, but you grant VoiceMe and other users of the Services a royalty-free, worldwide, perpetual licence to use, store and copy that content, and to distribute it and make it available to third parties.

We also have a right to disclose your identity to any third party who claims that any content posted or uploaded by you constitutes a violation of their intellectual property rights, their right to privacy or other rights. You must not use any part of the content on our site or App for commercial purposes without obtaining a licence to do so from us first. If you copy or use our Service in breach of this Agreement, your right to use our Service will cease immediately and you must, at our option, return or erase/destroy any copies of the materials you have made. In addition, we reserve the right to suspend or terminate your access to the Services.

REGISTRATION

When registering with VoiceMe, you agree to provide true, accurate, current and complete data to us, and to keep such data true, accurate, current and complete. If you provide data that is, or we suspect to be, false, inaccurate or incomplete, we reserve the right to suspend or terminate your access to the Services. In the event that you are provided with, or set up your own username and password or other security credentials, you are solely responsible for maintaining the confidentiality of the same, and will be responsible for all resulting uses and activities that occur as a result of your failure to maintain the confidentiality of such information, irrespective of whether the uses or activities were authorised by you.

CODE OF CONDUCT

You agree to use the Services in accordance with the following Code of Conduct:

We will not be responsible, or liable to any user or third party, for the content or accuracy of any content posted by you or any other user to our site/App. Please be aware that, since we do not take any responsibility for generally moderating user content, some users you encounter on the site or the App may behave inappropriately or unlawfully. Such users are solely responsible for such behaviour.

REMOVAL OF INFORMATION

We do not and cannot review all profiles, public postings, messages or other materials posted or sent by users of the Service. We are not responsible for any of the content of these profiles, public postings, messages or other materials. We reserve the right, but are not obligated to, delete, move or edit profiles, public postings, messages and other materials that we, in our sole discretion, deem to be in violation of the Code of Conduct as set out above or any other applicable content guidelines or deem to be otherwise unacceptable or unlawful. You shall remain solely responsible for the content of profiles, public postings, messages and other materials you may upload to the Service.

TERMINATION OF ACCESS

We may, in our sole discretion, terminate or suspend your access to all or part of the Service at any time, with or without notice, for any reason, including, without limitation, breach of this Agreement, without any liability to you. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity that may otherwise affect the enjoyment of the Service or the Internet by others may be grounds for termination of your access to all or part of the Service at our sole discretion, and you may be referred to appropriate law enforcement agencies by us.

INTERACTIONS WITH OTHERS

You are solely responsible for your interactions with other users. You understand that VoiceMe currently does not conduct criminal background checks on its users. VoiceMe also does not enquire into the backgrounds of all of its users or attempt to verify the statements of its users. VoiceMe makes no representations or warranties as to the conduct of users or their compatibility with any current or future users. VoiceMe reserves the right to conduct any criminal background check or other screenings (such as sex offender register searches), at any time and using available public records. To the maximum extent permitted by law, VoiceMe shall not be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other users of the Service. You agree to take reasonable precautions in all interactions with other users of the Service, particularly if you decide to meet offline or in person. You understand that VoiceMe makes no guarantees, either express or implied, regarding your ultimate compatibility with individuals you meet through the Service. You should not provide your financial information (for example, your credit card or bank account information) to other users.

EXTERNAL LINKS

The site and App may contain links to other internet sites and resources ("External Links"). These are provided for your information only, and you acknowledge that we are not responsible for and have no liability as a result of the availability of External Links or their contents. We have no control over external sites, and we suggest that you review the terms of use and privacy policies of such External Links prior to using them, as applicable.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Nothing in this Agreement excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law. You understand and agree that your use of our Services are at your own risk. Our Service is provided on an "as is" basis and, to the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

VoiceMe does not guarantee the accuracy, completeness, or timeliness of, or otherwise endorse any information contained on the site or within the App. You acknowledge that any use of the site or the App is at your own risk. We do not represent or endorse the accuracy or reliability of any user profile, advice, opinion, statement or other information displayed, uploaded or distributed through the service by VoiceMe, our partners or any user of the Service or any other person or entity. You acknowledge that any reliance upon any such user profile, advice, opinion, statement or information shall be at your sole risk. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

We only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Service.
We assume no responsibility for the content of websites linked on our site/App. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

COST OF USING OUR SERVICE

We do not guarantee that our site or the App will free of charge when using some of its features. Some features require access to the Intenet and will be technically directed through internet conncectivity as available when using your smartphone. You are responsible for configuring your own hardware and software in order to limit usage to a Wifi situation and/ or mobile data usage at rates and terms agreed with your relevant carrier. Any control of costs arising from that we will outside of our regime.

VIRUSES

We do not guarantee that our site or the App will be secure or free from bugs or viruses. You are responsible for configuring your own hardware and software in order to access our site and/or the App. You should use your own virus protection software. You must not misuse our site/App by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site/App, the servers on which our site/App is stored or any server, computer or database connected to our site/App. You must not attack our site/App via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site/App will cease immediately.

INDEMNITY

You hereby agree to indemnify, defend and hold harmless VoiceMe and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of this Agreement including the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defence of any such claim. VoiceMe reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you.

APPLICABLE LAW

This Agreement, its subject matter and its formation (including non-contractual disputes), are governed by English law. You and we both agree to that the courts of England and Wales will have exclusive jurisdiction to settle disputes arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes).
